Terms and Conditions
These Terms and Conditions of Service ("Terms and Conditions") are established by BusX (Thailand) Co., Ltd., including its subsidiaries, affiliates, associated companies, and jointly controlled entities (hereinafter collectively referred to as the “Company”, “BusX”, “we”, “us” or “our”). The purpose of this document is to define the rights, duties, and responsibilities of individuals who register and create an account (“BusX Account”), such as passengers, transportation service providers, online travel agents, and BusX partners participating in the program. These Terms apply to the use of BusX services through the websites www.thairoute.com, www.busx.com, the BusX mobile application, or any other authorized channels (hereinafter collectively referred to as the “User”, “you” or “your”).
1. Enforcement
- These Terms and Conditions apply to all individuals who register for a user account (“BusX Account”) and use our services through any channels, including www.thairoute.com, www.busx.com, the BusX mobile application, or any other authorized platforms. By registering and using our services, you are deemed to have acknowledged, accepted, and agreed to comply fully with these Terms and Conditions in all respects.
2. Definitions
- “User Account” or “BusX Account” refers to an account registered by the User to access the services, consisting of a username, password, and other personal information.
- “Products or Services” means any services provided by BusX, including but not limited to ticket purchasing, payment processing, travel schedule verification, and other support services.
- “Personal Data” refers to any information that can identify an individual, such as name, contact information, or national identification number, among others.
- “Account Information” means all data associated with a User’s account within the system, including login history, purchase and booking records, and payment transactions.
- “Force Majeure” means any event beyond the control of BusX, including but not limited to natural disasters, system or network failures, or government orders.
- “Improper Use” means any act or conduct that violates these Terms and Conditions, causes damage to the system, or infringes upon the rights of others.
3. Account Registration Conditions
- 3.1 Applicants must be natural persons of Thai nationality, aged 20 years or older, or possess other qualifications as may be prescribed or announced by the Company in the future.
- 3.2 You are required to provide personal information by completing the registration form as specified by us, in order for us to create your account, record your membership information, and send your Username and Password to you via email or SMS to your registered mobile number. We encourage you to use a unique and strong password that differs from those used for other services to ensure account security.
- 3.3 You must keep your email, username, password, and/or login credentials confidential and must not transfer or share your account access rights with any other person. In the event of a breach of this condition, such actions shall be deemed to have been performed by you personally and shall be legally binding, even if you did not directly engage in the activity. We shall not be liable for any loss or damage arising therefrom.
- 3.4 If you discover or suspect that your account information has been accessed or used without authorization, you should change your password immediately.
- 3.5 You must provide accurate and truthful information. If any information is found to be inaccurate, you may notify us through the available communication channels to allow us to correct or update your information accordingly. For service-related purposes, if the provided information is inaccurate, we may request additional documents for verification.
- 3.6 To facilitate convenience, you may use your Username and Password for Single Sign-On (SSO) authentication, allowing you to log in once to access all BusX-related services. The information provided during your BusX registration will enable you to create and manage your account, including your personal details, across our authorized channels such as www.thairoute.com, www.busx.com, and the BusX mobile application.
- 3.7 You agree that any electronic transactions conducted through our websites or applications shall be legally valid and enforceable in accordance with the Electronic Transactions Act B.E. 2544 (2001).
- 3.8 We reserve the right to retain computer traffic data for no less than ninety (90) days from the date the information enters our computer system, in compliance with the Computer Crime Act B.E. 2560 (2017) and its subsequent amendments.
4. Terms of Service Usage
- 4.1 We shall not be held liable for any damages arising from the use of our services in cases of force majeure or any other circumstances beyond our control, including but not limited to damage to your computer system, loss of data, inability to access or use the services due to third-party actions, or your own negligence.
- 4.2 We reserve the right to inspect, modify, or revoke your access rights to our services at our sole discretion, and such decisions shall be final. In the event that any fraudulent, falsified, or deceptive actions are discovered for the purpose of obtaining benefits from our services, whether in whole or in part including cases where you allow others to perform such actions, we reserve the right to deny or revoke those rights either partially or entirely without any obligation to compensate for damages.
- 4.3 We reserve the right to suspend or terminate your access to the services if we determine that your usage has unlawful purposes, facilitates illegal activities, infringes upon the rights of others, or causes harm or disruption to other individuals or our computer/network systems. Examples include:
- (1) Unauthorized access or any act that violates copyright or intellectual property terms stated in this Agreement.
- (2) Actions that infringe upon the rights of others or cause damage through negligence, including the dissemination of viruses, sending spam, intercepting computer traffic data, or hacking into our systems.
- (3) Unauthorized attempts to access computer data and/or systems belonging to us or others, or the creation of scripts/messages that disrupt, interfere with, or harm other users.
- 4.4 We shall not be responsible for any indirect, consequential, or incidental damages, including loss of profits, data, or other intangible losses, resulting from your use of or inability to use our services.
5. Account Access and Management
- 5.1 You may access your account using your email address or mobile phone number and password. Once logged in, you can:
- (1) Change your password.
- (2) Edit your contact information.
- (3) Update your username.
- (4) Access “API Credentials” and “Your BusX Information”
- 5.2 Account Deletion. You may permanently delete your account through the “Your BusX Information” menu by selecting “Deleting Your BusX Account.” Upon confirmation, we will terminate your access to our services and proceed to permanently delete your account data. Once deleted, your account cannot be recovered. However, certain information required by law may be temporarily retained for accounting or security purposes.
- 5.3 You have the right to access and download your personal data through the “Your BusX Information” menu by selecting “Download Your Information.”
6. Processing of Personal Data
- For the purpose of processing personal data, we may use methods that identify or enable the identification of users. We will process users’ personal data only to the extent necessary for legitimate and specified purposes. 7. Amendments to the Terms and Conditions of Service
- We reserve the right to modify, suspend, or terminate any part or all of the content on our websites or services at any time. These Terms and Conditions may be amended to reflect technological developments, changes in business operations, or new legal requirements. You are advised to review these Terms periodically when using our services. In the event of any material changes, we will notify you accordingly. Your continued use of our services after such changes shall be deemed as your acceptance and agreement to be bound by the revised Terms and Conditions of Service.
8. Governing Law
- 8.1 These Terms and Conditions of Service are prepared in the Thai language, which shall be the primary reference for interpretation and enforcement.
- 8.2 Any disputes arising out of or relating to these Terms and Conditions shall be governed by and construed in accordance with the laws of Thailand, and subject to the exclusive jurisdiction of Thai courts, without regard to its conflict of law principles. In the event that any provision of these Terms and Conditions is or becomes invalid, unenforceable, voidable, or void under the applicable law whether existing or enacted in the future such provision shall be ineffective only to the extent of that invalidity. The remaining provisions shall continue to be valid, enforceable, and binding in full force under Thai law.
