This Privacy Policy (“Policy”) describes how BusX (Thailand) Co., Ltd. and its respective subsidiaries, affiliates, associated companies and jointly controlled entities (collectively “BusX”, “we”, “us”, or “our”) collect, use, process and disclose your Personal Data through the use of BusX’s Apps and Websites (including all mobile applications (respectively “Apps” and “Websites”), products, features, and other services globally (collectively, “Services”).

This Policy applies to our customers, passengers, agents, vendors, suppliers, partners (such as driver partners) contractors, and service providers (collectively, “you”, “your”, or “yours”).

“Personal Data” is any information which may be used to identify you or from which you are identifiable. This includes but is not limited to your name, nationality, telephone number, bank and credit card details, personal interests, email address, your image, government-issued identification numbers, biometric data, race, date of birth, marital status, religion, health information, vehicle and insurance information.

COLLECTION OF PERSONAL DATA

We collect Personal Data about you in the ways listed below. We may also combine the collected Personal Data with other Personal Data in our collection.

You directly provide Personal Data to us

We collect your Personal Data when you voluntarily provide it to us. For example, you may provide your personal data to us by:

• filling out a user profile or registration form;
• providing information to assess your eligibility to provide services as a BusX driver partner;
• interacting with our social media pages;
• participating in contests or events organized by BusX;
• using biometric features to identify yourself; and
• filling out demographic information in surveys.

When our services are used

Personal Data may be collected through the normal operations in our Apps, Websites and Services. Some examples include:

• your location (to detect pick-up locations and abnormal route variations);
• feedback, ratings and comments from passengers;
• transaction information (such as payment method and distance travelled);
• information about your interaction with BusX Apps, Website or services (such as viewing your passengers’ feedback, or other features)
• device information (such as hardware model and serial number, IP address, file names and versions and advertising identifiers); and
• personal data you may enter in the messages when you use our App’s in-app communication features.

From other sources

When we collect Personal Data from other sources, we make sure the data is transferred to us in accordance with all applicable laws. Such sources may include:

• our referral programs;
• our business partners, such as bus companies and payment gateway providers;
• insurance and financial partners;
• publicly available data;
• government sources of data; and
• marketing services providers or partners.

Personal Data from users of BusX Driver App

If you are a driver-partner, we may collect and request:

• full name;
• business email address;
• other identifying information about the authorized user as reasonably requested by BusX;
• telematics data (such as your speed, acceleration and braking data);
• device data (such as accelerator data, GPS location, your IMEI number and the names of apps you have installed on your device); and
• your vehicle registration data.
• Permission to access:
  • CAMERA to take picture to decode QR code and barcode, to enable e-ticketing of our passengers;
  • READ_EXTERNAL_STORAGE to get photo to read QR code and barcode library from your device library; and
  • WRITE_EXTERNAL_STORAGE to save the QR code and barcode into internal storage

Sensitive Personal Data

Some of the information we collect is sensitive in nature. This includes such information as yor government-issued identification numbers, biometric data, race, date of birth, marital status, religion, or health information. We only collect this information when it is necessary to comply with legal or regulatory requirements.

When you provide Personal Data of other individuals to us

In some situations you may provide Personal Data of other individuals (such as your spouse, family members or friends) to us. For example, you have booked bus tickets for your whole family. If you provide us with their Personal Data, you represent and warrant that you have obtained their consent for their Personal Data to be collected, used and disclosed as described in this Policy.

WHY DOES BUSX COLLECT AND USE YOUR PERSONAL DATA?

BusX uses your Personal Data to provide and improve BusX’s Services, as well as to facilitate your reservations, bookings and e-ticketing and other Services provided by us (collectively and including below, the “Purpose”). More specifically:

• Travel Reservations: we use your Personal Data to complete and service your online travel reservations.
• Customer Service: We want to be there for you 24/7 to quickly answer all your questions or concerns. To do this we need to be able to provide our customer support team with your information.
• BusX Account: You can create a BusX user account, and your Personal Data enables you to access all of our Services. For example, you can set your reservation information to use for future reservations, retrieve completed reservations and e-tickets, take advantage of special offers for premium BusX users, and change, modify or request a refund for existing reservations based on fare rules set by the travel provider.
• Marketing: We use your Personal Data to provide you marketing activities including:
• Sending news of travel offerings and company updates when you make a reservation with us or if you set up an account. If you would like to unsubscribe from these marketing emails you can click “Unsubscribe” at the bottom of such emails. We may use your Personal Data to provide better trip opportunities and content that is more personalized. If you participate is promotion activities from us such as giveaways, sweepstakes, limited time offerings, special privileges, festive greetings and the like we may use Personal Data to administer such activities.
• Fraud Prevention: To make sure that only valid transactions occur on BusX, we and our travel partners may use your Personal Data to detect and prevent fraud and other activities that are illegal or in breach of our terms. Personal Data may be used for threat assessment and validation of transactions and reservations including immediate and retroactive blocking of certain transactions or reservations.
• Statistical Analysis for Product Improvement: We may perform statistical analyses of user behaviour in order to measure interest in the various areas of our Services to aid us in product development purposes. We make the outmost effort to use anonymized information when performing such analyses.
• User Reviews: We may ask you to provide a review of your experience with our transportation partners and our Services.
• Communication from Us: Periodically we may get in touch with you by email, phone, or social media based on the contact information you provided us and the reasons for the communication. Such reasons for communication from us to you include:
• In furtherance of assisting you with a transaction or reservation you made or are trying to make;
• If you have not finished a reservation we may contact you to remind you and offer help in completing the reservation to ensure you are successful in fulfilling your travel needs;
• We may send information that we believe would help you with your reservation, such as a reminder of your upcoming travel details;
• Administrative and other messages that we believe are necessary for your satisfied use of BusX; and
• Legal Purposes: In certain cases we might need to use your Personal Data that you provide us in furtherance of resolving legal disputes, for regulatory investigation and/or compliance, to enforce the BusX reservation terms or to comply with lawful requests from law enforcement.
• • BusX Driver App Users: for our transportation partners and their drivers, we may need to authenticate the driver as an authorized user acting on behalf of our transportation partners, to enable advanced Services in conjunction with our transportation partners.

DISCLOSURE OF PERSONAL DATA

We need to share your Personal Data with various parties for the Purposes. These parties include:

Other users

For example, if you are a passenger, we may share your pick-up and drop-off locations with the transportation provider and their drivers.

If you are a transportation provider/driver, we may share your Personal Data with your passengers including your name and photo, your vehicle make, model, number plate, location and average rating.

With third parties

For example, we may share a driver’s location and name with third parties when a passenger uses the “Share My Ride” feature or activates the Emergency Button.

With BusX partners at your request

For example, if you requested a service through a BusX partner or used a promotion provided by a BusX partner, we may share your Personal Data with that BusX partner. Our partners include partners that integrate with our App or our App integrates with, vehicle services partners, or business partners which BusX collaborates with to deliver a promotion, competition or other specialised service.

With the owner of BusX accounts that you may use

For example, your employer may receive trip data when you use your employer’s BusX account.

With subsidiaries and affiliates

We share Personal Data with our subsidiaries, associated companies, jointly controlled entities and affiliates.

With BusX’s service providers and business partners

We may provide Personal Data to our vendors, consultants, marketing partners, research firms, and other service providers or business partners. This includes:

• payment processors and facilitators;
• background check and anti-money laundering service providers;
• cloud storage providers;
• marketing partners and marketing platform providers;
• data analytics providers;
• research partners, including those performing surveys or research projects in partnership with BusX or on BusX’s behalf;
• fleet and merchant partners;
• insurance and financing partners; and
• vehicle solutions partners, vendors or third-party vehicle suppliers.

With our legal advisors and governmental authorities

We may share your Personal Data with our legal advisors, law enforcement officials, government authorities and other third parties.

RETETION OF PERSONAL DATA

We shall retain your Personal Data for as long as you maintain your BusX account. Once your Personal Data is no longer necessary for the Services or Purposes, or we no longer have a legal or business purpose for retaining your Personal Data, we take steps to prevent access or use of such Personal Data for any purpose other than compliance with this privacy policy, or for purposes of safety, security, fraud prevention and detection.

INTERNATIONAL TRANSFERS OF PERSONAL DATA

Your Personal Data may be transferred from country, state and city (“Home Country”) in which you are present while using our services to another country, state and city (“Alternate Country”). You understand and consent to the transfer of your Personal Data from your Home Country to the Alternate Country.

COOKIES

BusX, and third parties with whom we partner, may use cookies, web beacons, tags, scripts, local shared objects such as HTML5 and Flash (sometimes called “flash cookies”), advertising identifiers (including mobile identifiers such as Apple’s IDFA or Google’s Advertising ID) and similar technology (“Cookies”) in connection with your use of the Websites and Apps. Cookies may have unique identifiers, and reside, among other places, on your computer or mobile device, in emails we send to you, and on our web pages. Cookies may transmit Personal Data about you and your use of the Service, such as your browser type, search preferences, IP address, data relating to advertisements that have been displayed to you or that you have clicked on, and the date and time of your use. Cookies may be persistent or stored only during an individual session.

BusX may allow third parties to use Cookies on the Websites and Apps to collect the same type of Personal Data for the same purposes we do. Third parties may be able to associate the Personal Data they collect with other Personal Data they have about you from other sources. We do not necessarily have access to or control over the Cookies they use.

Additionally, we may share non-personally identifiable Personal Data with third parties, such as location data, advertising identifiers, or a cryptographic hash of a common account identifier (such as an email address), to facilitate the display of targeted advertising.

If you do not wish for your Personal Data to be collected via Cookies on the Websites, you may deactivate cookies by adjusting your internet browser settings to disable, block or deactivate cookies, by deleting your browsing history and clearing the cache from your internet browser. You may also be able to limit our sharing of some of this Personal Data through your mobile device settings.

A SPECIAL NOTE ABOUT CHILDREN

Children are not eligible to use BusX’s Services, and we ask that minors not submit any personal information to us. If you are a minor, you may use this service only in conjunction with a parent or legal guardian. BusX does not knowingly collect personal information from minors.

AMENDMENTS & UPDATES

BusX shall have the right to modify, update or amend the terms of this Policy at any time by placing the updated Policy on the Websites. By continuing to use the Apps, Websites or Services, purchase products from BusX or continuing to communicate or engage with BusX following the modifications, updates or amendments to this Policy, you signify your acceptance of such modifications, updates or amendments.
